The PFAS multidistrict litigation (MDL No. 2873) is moving forward in the District of South Carolina, where over 10,000 cases remain active against major manufacturers like 3M, DuPont, and BASF. While 3M reached a $10 billion settlement in 2023 to resolve water utility claims, no global settlement has been reached for individual personal injury lawsuits.
Latest Updates and Case Status
In July 2025, 3M agreed to a settlement with the State of New Jersey to resolve PFAS-related contamination claims for up to $450 million over 25 years. The agreement addresses environmental and health impacts without an admission of liability.
As of mid-2025, the court is focused on expert discovery and has begun narrowing down bellwether cases involving kidney and testicular cancer. A Science Day held in June 2025 introduced key research linking PFAS exposure to cancer, which will help shape future rulings on expert testimony.
The first bellwether trial is set for October 2025, with discovery expected to wrap up by late summer. These early trials are expected to influence the direction of the litigation and potential settlement talks. In late June 2025 the Judge urged defendants, including 3M, DuPont, BASF, and others, to prioritize settlement negotiations before the bellwether trials begin. With deadlines approaching and the litigation progressing quickly, affected individuals should act now to preserve their claims.
